At Michelle O’Shea & Co we have been submitting applications for registration of title of whole online since the online system was first implemented in October 2013 and we find the system works very well. There is no longer the need to print and photocopy documents and send them by post, they can all be scanned in and certified as being true copies online. By submitting applications online in this way, our clients benefit for paying a reduced land registration fee.
However, some types of application are subject to higher land registration fees. If the property you are proposing to purchase is a newly built property on a bigger development or the property is being transferred as part of a registered title already, you will not be able to benefit from the reduced land registration fee. Also, if the property you are purchasing has a title which has not yet been registered at the land registry then again you will not benefit from the reduced land registration fee. This is likely to apply to a property that has not changed hands for many years where the last time it changed hands the area in which the property falls was not an area where title had to be registered on change of ownership.
If you instruct us to act on your behalf and upon receipt of draft Contract papers it is apparent that you will not benefit from the reduced land registration fee we will advise you immediately this becomes known to us so that you can budget properly for the higher registration fee that is going to be payable on completion of your purchase. Otherwise you will benefit from the reduced land registration fee payable.
