Selling your Property

We can act on your behalf in relation to any sale of a residential property in England and Wales, whether it is a house, flat or piece of land.

You may be wondering what it is exactly that we do when acting on a sale of a property. To assist, a brief outline of a typical transaction is set out below.

There are 2 important stages in a sale transaction:

1. Exchange of Contracts – this commits the Seller to sell and the Buyer to buy the Property at the agreed price.

2. Legal completion – this is when the balance purchase monies are received and the Seller moves out of the property.

WHAT WE DO

(A) PRIOR TO EXCHANGE OF CONTRACTS

  1. Obtain the title deeds to the property (if the title is currently unregistered) or (if title is registered at the Land Registry) obtain Official Copy entries from the Land Registry.
  2. Issue a draft Contract with supporting title documentation to the Buyer’s solicitors/conveyancers.
  3. Obtain the Seller’s instructions upon various enquiries contained in the form of a Seller’s Property Information Form with regard to various aspects of the property, including what fixtures and fittings are included in the price.
  4. 4. Deal with any further enquiries raised by the Buyer’s solicitors/conveyancers on the documents supplied including obtaining the Seller’s instructions on the same
  5. Agree with the Buyer’s solicitors/conveyancers a completion date which suits all parties.
  6. Obtain the Seller’s signature to the Contract and Transfer in readiness for exchange of Contracts.

(B) EXCHANGE OF CONTRACTS

  1. Exchange one copy of the Contract signed by the Seller with the copy signed by the Buyer. Exchange of Contracts is usually agreed over the telephone with each parties solicitor/conveyancer agreeing to post their respective clients’ signed Contract to the other solicitor/conveyancer in that days post. A date is fixed for legal completion at that time and we agree to receive a deposit from the Buyer’s solicitors/conveyancers usually representing 10% of the sale price.

(C) AFTER EXCHANGE OF CONTRACTS

  1. Obtain a repayment figure from any mortgage lender.
  2. Notify the selling agents (if any) that exchange of Contracts has been effected and request that they issue their commission account to us in readiness for completion.

(D) ON COMPLETION

  1. Receive the balance purchase monies from the Buyer’s solicitors/conveyancers.
  2. Repay all mortgages registered on the property and obtain the relevant discharge documents from the lenders concerned.
  3. Pay the selling agents fees and forward any balance to the seller.
